Annual Leave Law Basis and Missing Conditions

Reference date and last reviewed: July 11, 2026

Calculation Basis

Simplifies Article 60 rules: one day per fully attended month, 15 days after at least 80% annual attendance, and one added day per two years from three years of service up to 25.

Reference Limits

It does not input actual attendance, absences, leave periods, part-time schedules, fiscal-year proration, used days, or leave-use promotion, so it cannot determine a legal balance.

When to Confirm Officially

If employer records differ or separation settlement, attendance, leave periods, use promotion, or unused-leave pay is disputed, review work rules and records with a labor professional or the labor authority.

Anniversary-basis annual leave calculation

Last reviewed: July 11, 2026

Simplified grant after one year

current grant = min(25, 15 + floor((completed service years−1)÷2))

Before one year, the model uses fully completed months up to 11 days. After one year, it starts at 15 days and adds one day for each two years beyond the first completed service year.

Example: hired 2023-01-01, calculated 2026-07-01

  • • Hire date: January 1, 2023
  • • Calculation date: July 1, 2026
  • • Anniversary grant basis
  1. 1. 1,277 service days and 3 completed service years
  2. 2. current grant: 15 + floor((3−1)÷2) = 16 days
  3. 3. simplified period grants: 11 + 15 + 15 + 16 = 57 days

The current grant is 16 days, while the tool’s period-by-period grant total is 57 days.

How to read the result

  • The current grant and the sum of all historical period grants are different measures.
  • A fiscal-year policy is an employer allocation method and should be reconciled so it is not less favorable at separation.
  • Remaining leave in this tool is the current grant reference, not an HR balance after used days.

Conditions that change the result

  • The inputs do not determine 80% attendance, monthly full attendance, absences, or protected leave treatment.
  • Under-15-hour schedules, part-time work, fiscal-year proration, and work rules need separate review.
  • Amendments with later effective dates must be checked against the date being calculated.

Common input mistakes

  • Do not enter the day after separation or reverse hire and calculation dates.
  • Do not read the 57-day historical total as 57 unused days.
  • Do not treat fiscal-year allocation as identical to statutory anniversary accrual.

Reference Knowledge

  • Article 60 of South Korea's Labor Standards Act provides 15 days of paid annual leave for workers with at least 80% attendance during one year, with additional days by service period and a 25-day cap.
  • For workers under one year of service, or below 80% attendance during one year, the simplified reference structure grants one paid leave day for each fully attended month.
  • Workers averaging under 15 weekly hours can be treated differently for statutory paid annual leave and should confirm the exact rule.
  • Fiscal-year grants, prorated mid-year hire handling, leave or absence periods, childcare leave, and part-time schedules can differ by employer policy and records.
  • Leave-use promotion procedures under Article 61 can affect unused leave pay, so settlement review should include employer notices and records.

FAQ

Q.How is this different from the annual leave pay calculator?

A.

This calculator estimates granted leave days. The annual leave pay calculator estimates pre-tax payout by multiplying actual unused leave days by ordinary daily wage.

Q.Should I choose anniversary basis or fiscal-year basis?

A.

Choose anniversary basis if the employer grants leave by each employee's hire date. Choose fiscal-year basis if leave is granted by a shared company date such as January 1. Employer prorating can still differ.

Q.Can this differ from my employer HR system?

A.

Yes. Leave, absence, childcare leave, part-time schedules, fiscal-year proration, and leave-use promotion handling can change the actual balance. Treat the result as a reference estimate.

Q.Where do I enter used leave days?

A.

Check employer HR records or payslips if possible. If you enter 0, the tool shows estimated granted leave before subtracting used days.

Q.Can I calculate the payout amount here?

A.

No. This tool focuses on leave days. Use the annual leave pay calculator for payout amount after you know the unused leave balance.

Q.Can I use a resignation date as the calculation date?

A.

Yes. For settlement review, enter the resignation date or settlement reference date as the calculation date. Final employer settlement can still depend on the last working day, when used leave is recorded, fiscal-year grant policy, and leave-use promotion procedures.
